Exclusivity and Non-Compete Clauses in OnlyFans Agency Contracts
Exclusivity clauses decide what else you're allowed to do while you're with an agency, and sometimes after you leave. Some are reasonable. Others quietly give an agency a share of everything you earn anywhere, or stop you working with anyone else for a long time. Here's how to tell the difference.

What is an exclusivity clause in an OnlyFans agency contract?
An exclusivity clause says you'll use only that agency for certain work during the contract. It might cover just your OnlyFans account, all subscription platforms, or all your online income. A non-compete clause goes further, restricting what you can do, or who you can work with, after the contract ends.

Can you work with two OnlyFans agencies at once?
On the same account, it's rarely a good idea even if allowed, because two teams in one inbox causes confusion. On different accounts or platforms, it depends on your contracts. Check whether either agreement claims exclusivity over all your accounts, platforms or income before bringing in a second agency.
Which exclusivity terms are reasonable?
Exclusivity that matches the work the agency actually does is generally reasonable: it stops two teams working on the same account and protects the agency's investment in you. Terms that reach income or platforms the agency doesn't work on, or that last long after you leave, deserve pushback.
Questions to ask about any exclusivity clause:
- Which accounts and platforms does it cover?
- Does it cover income the agency had no part in, such as brand deals you arrange?
- Does any part of it continue after the contract ends? For how long?
- What happens if you breach it: a fee, commission, or termination?
- Does it stop you working alone, or only with other agencies?
Are non-compete clauses enforceable?
It depends on where you live and the wording. In England and Wales, restrictions after a contract ends are generally only enforceable if they protect a legitimate business interest and go no further than reasonably necessary. In the US, it's mostly state law; California, for example, voids most non-compete agreements. Get legal advice on any specific clause.
The practical point: even a clause that might not be enforceable can cause stress and legal costs. It's far easier to negotiate it out before you sign than to fight it later.
How do exclusivity clauses affect other platforms?
If you use, or might use, Fansly, Fanvue or other platforms, check whether your agency's exclusivity covers them. If it does, the agency should be doing real work there. How do exclusivity clauses interact with bonuses and lock-ins?
Exclusivity is often bundled with signing bonuses, advances or long minimum terms, and the combination is what makes contracts hard to leave. What should a fair contract say?
A fair contract limits exclusivity to the accounts the agency manages, charges commission only on that income, ends all restrictions when the contract ends (apart from limited staff non-solicitation), and lets you leave on reasonable notice. You should keep ownership of your accounts and content throughout.

Frequently asked questions
Can an agency take commission on my brand deals?
Only if your contract says so. Many creators negotiate commission to cover only the platforms and income the agency actually works on. Check the definition of "revenue" or "income" in the contract.
Can an agency stop me managing my own account after I leave?
A clause that stops you running your own account after the contract ends would be unusual and may be hard to enforce, but get legal advice on the wording. Don't sign anything that suggests it.
Is a non-solicitation clause normal?
A clause stopping you from hiring the agency's staff directly for a limited time is common. Check it has a reasonable time limit and doesn't stop you working with people you knew before.
What happens if I break an exclusivity clause?
It depends on the contract. Consequences might include termination, a fee or a commission claim. Read the clause carefully and get advice before acting if you think you might be in breach.
